Child Custody & Access Lawyer

Trusted Legal Guidance for Child Custody, Access, Parenting Time & Decision-Making

Child Custody and Access Ontario

Many of us are familiar with the traditional family law terms of “custody” and “access”.

Recent changes to the Divorce Act have replaced those terms with Parenting Time, Decision Making Responsibility and Parenting Orders. Family law is guided by the principle of what is in the “best interests of the child.”

However, it is often difficult for parents to agree on what is best for the children when they are in the other party’s care. Even where the parties begin with good intentions, these often become highly-contested issues that requires extensive legal assistance, especially when new partners enter the equation, or one party seeks to relocate.

Unfortunately, parental alienation – where one party actively seeks to damage the child’s relationship with the other parent - is also common. I firmly believe that both parents must do everything in their power to ensure they do not subject their children to a bitter, dysfunctional, and damaging situation.

Our clients can expect relentless advocacy where the best interests of children are at stake.

Selecting the right child custody lawyer is crucial to protecting your family's well-being and securing the best outcome for your child.

At Michael Coristine Law, we provide compassionate yet relentless representation, helping parents navigate custody, access (parenting time), and decision-making responsibilities. Led by former senior Crown Attorney Michael Coristine, our team combines extensive legal experience with a strategic, results-driven approach to help resolve custody matters effectively while minimizing conflict.

We prioritize both your parental rights and your child's best interests, working toward fair, practical solutions that promote stability and positive co-parenting.

What You Need to Know:

Understanding Child Custody & Parenting Time

  • In Ontario, custody refers to the legal decision-making responsibility for a child, while access (now called "parenting time") determines how much time each parent spends with the child.

Types of Child Custody

  • Sole Custody – One parent has full decision-making authority.

  • Joint Custody – Both parents share decision-making responsibilities.

  • Shared Custody – Each parent has the child for at least 40% of the time.

  • Split Custody – Each parent has primary custody of one or more children.

Factors Courts Consider

in Custody & Parenting Time Decisions

  • Best interests of the child (primary consideration)

  • Parenting abilities & child’s emotional well-being

  • Child’s relationship with each parent

  • History of caregiving & stability

  • Child’s wishes (if mature enough)

  • Parental cooperation & communication

  • Any history of abuse or neglect

Common Questions

About Child Custody & Access

  • How does a court decide custody?

    • The child’s best interests are the top priority, considering parental involvement, stability, and well-being.

  • What if we agree on custody and parenting time?

    • You can create a Parenting Agreement outlining custody and access terms. Courts generally approve fair agreements.

  • Can a custody order be changed?

    • Yes. If there’s a significant change in circumstances, such as relocation or safety concerns, you can request a modification.

  • What happens if a parent denies access?

    • Parenting time is a legal right unless restricted by the court. Denying access without valid reasons can have legal consequences.

    • Grandparents can apply for custody or access if it’s in the child’s best interests.

  • Can a parent move with the child after separation?

    • A relocating parent must give at least 60 days' written notice, and the other parent can challenge the move in court.
